The Florida International Rally & Motorsport Park filed a civil suit against the Keystone Airport Authority–the board that votes on how to develop and operate the airport’s property, which includes the land the FIRM uses for its activities.
What’s the key underlying issue to all of this? The FAA says part of the road course resides in a Runway Protection Zone (RPZ). This forced the FIRM to adjust its track configuration in February. It got a temporary allowance from the FAA to run the full course in April while it came up with plans for a permanent reconfiguration solution.
The FIRM said that the KAA demanded it remove the portions of the track within the RPZ in June, with threats of the KAA removing it for them and the FIRM facing lease termination. Soon thereafter, the FIRM sued the KAA.
The FIRM further contends that the KAA knew of the RPZ issue long before the current leaseholders of the FIRM were made aware of it. The FIRM said the KAA permitted it being built within the RPZ without FAA approval and did not disclose that to the current leaseholders. Through the Freedom of Information Act, it discovered the FAA had emailed the KAA about the RPZ issue as early as 2014, but took no corrective action and did not inform the FIRM of the problem.
In the meantime, the FIRM also filed a temporary restraining order and preliminary injunction to prevent the KAA from taking any action on the FIRM’s premises or against its lease. The hearing for that is slated for July 31. The FIRM said it’s business as usual, though, with its track open for regular activities.
That is very unfortunate that the airport authority has acted in such a underhanded manner. I hope that some how there is a favorable outcome for this situation.
Hmm. I thought the parties were headed towards a solution with everyone happy.
I hope the Firm can enjoy a great relationship with the community. I feel fortunate to have it nearby to me. It's a fantastic test track and everyone I've met there is great.
The drag strip closest to me uses the old runway at an airport. The big airport about thirty miles away is getting all sorts of noise complaints because it is now surrounded by housing that wasn't there when it was built 70 or so years ago. So now things are beginning to move out to the airport with the drag strip, with predictable problems for the drag strip.
The airport authority in the county on the other side of mine pulled a sneaky one on the 3/8ths mile asphalt oval about two years ago. Now it's a playground for motocross, after they tore the asphalt up, because he was willing to pay more a month than the short track was. Doesn't bring in anywhere near the revenue to the county, but hey, they get about $2k more a month in rent.
So once proper damages for fraud are awarded will that finance the construction of trackside condos? ![]()
FIRM management posted this to its Facebook account on August 22.
